Outback Pods – Terms and Conditions

  1. Definitions
    1.1 In this Contract:
  • “You” means the customer entering into this contract with Outback Pods.
  • “Outback Pods” means Direct Supply Solutions Pty Ltd, including its agents, employees, contractors, and affiliates.
  • “Contract” means these Terms and Conditions, including the Purchase Transaction and any other documents incorporated by reference.
  • “Purchase Transaction” means the order confirmation, invoice, or quotation provided by Outback Pods for products or services.
  1. Acceptance
    2.1 By placing an order or accepting delivery, You accept these Terms and Conditions.
    2.2 Any variation must be agreed in writing by Outback Pods.
  2. Orders & Pricing
    3.1 Orders are subject to acceptance by Outback Pods.
    3.2 Outback Pods may cancel orders before dispatch.
    3.3 Outback Pods may adjust prices for errors, omissions, or cost changes.
  3. Payment & Title
    4.1 All payments are due in full as per the Purchase Transaction before dispatch.
    4.2 Ownership remains with Outback Pods until full payment is received.
    4.3 Failure to accept delivery within 3 months may result in termination, forfeiture, or restocking fees.
    4.4 Standard  products (non-customised) require an invoice for 10% of the total purchase price to secure the stock. The final 90% is due 14 days prior to delivery.
    4.5 For customised orders, a 50% nonrefundable deposit is required if you are customising your order.  The remaining amount is required 14 days prior to delivery.
  1. Delivery & Risk
    5.1 Delivery dates are estimates only.
    5.2 Risk passes to You on delivery, including unloading, site placement, and on-site manoeuvring.
    5.3 You must provide safe access, suitable machinery, and a prepared site.
    5.4 You must notify Outback Pods in writing of any transit damage within 48 hours; otherwise, delivery is deemed accepted.
    5.5 Additional fees may apply for self-unloading vehicles or extra machinery.
    5.6 Outback Pods is not liable for delays, damage, or extra costs from restricted access, site unsuitability, or environmental factors.
    5.7 If you can’t accept delivery on the day due to not having the site access available etc, you’ll be charged a redelivery fee if we need to take it back to our yard and return at a later date.
    5.8 Delivery is only to the curb (or nearest drop off point) on your property. If we can safely/easily get to your preferred location we’ll endeavour to help, but this is not a guarantee. If we deem it dangerous or unsuitable we’ll deliver the item to the safest location and it is then your responsibility to relocate the unit to your desired location at your cost.
    5.9 Our delivery cost, although to the curb, doesn’t include taking the product off the truck. You’ll need to organise a separate Franna or crane (or specialised local unloading equipment) to unload the studio/pod etc off our truck and place it in position. This cost varies and is excluded from our quotes/invoices. You accept that you’ll need to organise this prior to delivery (we recommend organising 2 weeks out from delivery to avoid issues). You accept that if we arrive and you have not organised this that we will need to return at another date in time and recharge you an additional delivery cost due to not being able to unload your product. We are happy to help you organise this at an additional cost, but we need advance notice of this prior to our delivery.
  1. Site Preparation & Approvals
    6.1 You are responsible for ensuring the site is suitable, level, stable, and compliant with local regulations.
    6.2 You must obtain all necessary permits, approvals, and comply with building codes.
    6.3 Outback Pods is not liable for fines, penalties, or delays arising from non-compliance or unsuitable site conditions.
  2. Warranties & Modifications
    7.1 Products come with a 12-month warranty unless otherwise stated.
    7.2 Warranty applies only if correct installation and intended use apply.
    7.3 Unauthorised modifications, site issues, or incorrect installation void warranties.
  3. Safety & Installation
    8.1 You are responsible for safe handling, installation, and compliance with regulations.
    8.2 Outback Pods is not liable for injury, death, or property damage arising from unsafe practices.
    8.3 You are responsible for costs associated with hiring licensed tradespeople if required.
  4. Insurance & Liability
    9.1 You must insure the product during transport, delivery, and after delivery.
    9.2 Outback Pods is not liable for uninsured losses.
    9.3 To the maximum extent permitted by law, Outback Pods’ total liability is limited to the purchase price of the product.
    9.4 Outback Pods is not liable for indirect, incidental, or consequential losses (e.g., lost income, rent, business interruption).
    9.5 Outback Pods is not liable for external contractors or services you obtain to help move the products into position (i.e. if you hire a crane etc and an issue arises.)
  1. Product Use & Utilities
    10.1 Products must be used in accordance with instructions and laws.
    10.2 You are responsible for all connections to electrical, plumbing, gas, or other utilities.
    10.3 Outback Pods is not liable for injury, property damage, or regulatory breaches from such connections.
  2. Returns & Cancellations
    11.1 No cancellations or refunds for customised orders unless agreed in writing.
    11.2 No refunds for change of mind or delivery/manufacturing delays unless agreed in writing.
  3. Disputes & General
    12.1 Disputes not resolved within 30 days must go to Alternative Dispute Resolution; if unsuccessful, arbitration may be used.
    12.2 Outback Pods may assign or subcontract obligations without Your consent.
    12.3 Notices may be sent via email, post, or facsimile and are deemed received according to standard rules.
    12.4 Governing law: NSW, Australia.
  4. Product Condition
    13.1 Products are purchased overseas, shipped and assembled in Australia. As such there is expected to be slight blemishes in finishes, scuffs etc from handling such large products. You accept this as part of the purchase and understand that this doesn’t constitute a fault or warranty claim with the product.
  5. Acts of God
    14.1 Outback Pods is not liable for any delay or failure to perform due to causes beyond its reasonable control or through acts of God. Outback Pods is not liable for any damage, loss, or delay caused by extreme weather, natural disasters, flooding, fire, hail, cyclones, or other events outside its control.
  1. Storage Fees
    15.1 If delivery is delayed at Your request or inability, storage fees apply of $40 per unit per week.
    15.2 Fees must be paid prior to delivery.
  1. Replacements & Repairs
    16.1 Replacement parts are fitted at Your expense.
    16.2 Repairs/replacements by You or third parties are at Your expense unless agreed in writing.
